File Submitted by: Gail Hutchcraft Date Submitted: February 5, 2006 ****************************************************************** Last Will and Testament Herman Ruther of the village of Saybrook in the County of McLean and State of Illinois, made and published the Twelfth day of October, in the year of our Lord, One Thousand Nine Hundred Twenty-Six. In the name of God, Amen, I, Herman Ruther, of the village of Saybrook in the County of McLean and State of Illinois of the age of Sixty- three years and being of sound mind and memory, do hereby make, publish and declare this my last will and testament, in manner following, that is to say: FIRST – It is my will that my funeral expenses and all just debts be fully paid. SECOND – I give and bequeath to my relatives by blood and to the blood relatives of my deceased wife in manner following, after my property has been disposed of in manner hereinafter directed by and to my executor hereinafter named. THIRD – All my personal estate of every kind and character shall be sold by my executor for cash. FOURTH – All money in bank shall be subject to disposition of my executor in liquidation of indebtedness to which shall be added the amount received from sale of my personal property. FIFTH – It is my desire that my property in the village of Saybrook be sold to best advantage as soon after my decease as practical, the proceeds to be used for the liquidation of mortgage indebtedness on my farm hereafter mentioned. SIXTH – After five years from March 1st, 1927, that is, March 1st, 1933, my farm in section seventeen and twenty in Cheneys Grove Township, McLean County, Illinois, be sold by my executor, all costs and indebtedness being paid, the residue, after paying Hels Anderson five dollars, shall be divided share and share alike between the following blood relatives of mine and blood relations of my wife; said proceeds to be divided into nine equal shares, one share to my brother Fritz Ruthers Children of Hamburg, Germany, one share share to my brother August Ruthers children of Hamburg, Germany, one share to my brother William Ruthers children of Helix, Oregon, one share to my sister Mrs. Anna ________ children of _______, Holstein, Germany, one share to my sister _________ Stroh children of Numpa, Idaho, one share to the children of my wife’s brother, Robert Hausen, of Canton, Henrich, Switzerland, one share to the children of my wifes sister, ______________________, walsman of Canton, Neurich, Switzerland. My farm having been rented to William Aaron for five years from March first, 1927, my executor is hereby directed to collect all rents, pay all taxes, repairs, insurance and __ or incidental expenses out of rents, and should there be an overplus it shall be added to the amount of farm sale and be divided with it as per sixth article of this instrument. LASTLY – I hereby nominate and appoint Charles D. Pervin, to be the executor of this, my last will and testament with bond, hereby revoking all former wills by me made.
